Warranties and Disclaimers
DISCLAIMER: EXCEPT AS EXPRESSLY PROVIDED, OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US IN THE 6 MONTHS PRECEDING THE CLAIM.

Free Trial Period

No Refunds Policy
All sales are final. Once you have completed a purchase or your free trial has ended and you have been charged for a subscription, all payments are non-refundable under any circumstances. This includes but is not limited to:

However, by using our service after your free trial ends, you expressly agree to begin performance immediately and acknowledge that you lose your right of withdrawal once you begin using the paid service.

Other Jurisdictions: Any mandatory consumer protection rights under your local law that cannot be waived.
Nothing in this policy limits rights you may have under applicable consumer protection laws that cannot be excluded by contract.
Chargebacks
Initiating a chargeback or payment dispute instead of contacting us may result in:

Permanent account termination if the chargeback is found to be invalid

If negotiation fails, disputes may be resolved through mediation or arbitration
The governing law shall be the laws of Wyoming
Venue for any legal proceedings shall be Wyoming
Agreement to Arbitrate
Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA).
Arbitration Procedures
Arbitration will be conducted by a single neutral arbitrator
Arbitration shall take place by phone or video conference
Each party shall bear its own costs and attorneys' fees unless otherwise awarded by the arbitrator
The arbitrator's decision shall be final and binding
Exceptions to Arbitration
The following disputes are not subject to arbitration:
Small claims court actions (subject to jurisdictional limits)
Injunctive or equitable relief to protect intellectual property rights
Disputes that cannot be arbitrated under applicable law
Class Action Waiver
YOU AND PIXELPOINT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Force Majeure
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, terrorism, labor disputes, or government actions.
Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated through our website or via email. Continued use of our services after changes constitutes acceptance of the modified terms.
General Provisions
Entire Agreement: These terms, together with any project agreements, constitute the entire agreement between parties.
Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
No Waiver: Failure to enforce any right does not constitute a waiver of that right.
Assignment: You may not assign these terms without our written consent. We may assign our rights and obligations.
